Vehicle Purchase and Sales, Terms & Conditions

Sushicars, SushiCars, Sushicars.com, "SC", Lazy Horse Media, "LHM", their respective owners and employees, shall all be considered the seller, herein referred to as "SushiCars".

Limitation of Liability - general. If any conflict is found, the policy most favorable to SushiCars shall rule. 

1.

SUSHICARS makes no representations or warranty about the validity, accuracy, correctness, reliability, quality, stability, and/or other problems with the information, products and services provided except warranty expressly stated herein. 

 

2.

SUSHICARS is not responsible for any delay in shipping the unit purchased/ordered. But we always help you to sort out any problem if it is under our control.

 

3.

Customers are solely responsible for all of the terms and conditions of the transactions conducted on, through or as a result of use of the Site, including, without limitation, terms regarding payment, returns, warranty, shipping, insurance, fees, taxes, title, licenses, fines, permits, handling, transportation and storage.

 

4.

Under no circumstances shall SUSHICARS be held liable for a delay or failure or disruption of the content or services delivered resulting directly or indirectly from acts of nature, forces or causes beyond its reasonable control, including without limitation, Internet failures, computer, telecommunications or any other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, flood, storms, explosions, Acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals or non-performance of third parties

 

5.

SUSHICARS reserved the rights of canceling any fraud/incomplete order without any prior intimation in written or verbal.

 

6.

Under no circumstances is SUSHICARS liable for any refund against any purchase made through us from any other dealer, service or other provider.

Service Provision 

​

Sushicars will provide the service listed on the invoice, our usual vehicle delivery shall include;

​

  • Your new vehicle!

  • Delivery to us by car-carrier from a trusted local dealer (Japan purchase) or our own inventory.

  • Basic detail package (interior and exterior, clean, wash etc.)

  • Our own multi-point intake inspection in Japan

  • Car history report, including vehicle milage verification to add value if you sell later, and give peace of mind that you are getting a legitimate vehicle as described. 

  • Video tour with the vehicle in Japan before we ship it out - see it and go over it before it comes over! Usually 10-20 minutes and longer can be arranged if needed (hourly rates apply)

  • Pre-Export prep and final checks. Verify and document before going to carrier for transport to Canada.

  • Delivery to port for Ocean Freight.  

  • International Ocean Freight, included. Optional marine insurance is extra

  • Documentation required for import including

    • Bill of Lading,

    • Invoice from Sushicars 

    • Export Certificate (original, Japanese) and translated copy both included.

    • In-bond document where applicable shall be provided.

  • Detailed instruction on the simple steps to import in Canada (where to go, who to see, what to bring). 

  • List of brokers if you decide not to do it yourself (we encourage you to do it yourself and save the money!)

  • List of local recommended shops, people and other resources if you need anything along the way, or even for years after buying, to keep you happy for years to come as well.

Good Faith

​

The customer and Sushicars shall conduct all business "in good faith". Without exception.

Vehicle Purchase

​

Please ask questions and inspect your vehicle as fully as possible prior to purchase. 

​

Each vehicle is carefully purchased and we are committed to selling or sending vehicles in a fully transparent manner. It is our commitment to ensure that we do our best to find this information and disclose it to the customer as early as possible. At no time shall Sushicars attempt to defraud a customer by intentionally hiding damages, and shall do their best to achieve complete honesty through inspections, observations or deductions from documents, physical condition or discussions with our own partners or others, or other methods. At no time shall Sushicars intentionally deceive the customer. The customer shall also be fully transparent in business and shall also agree to never deceive Sushicars, or it's officers and agents or any representative or partner, before, during or after the transaction.  Customers shall hereby accept that any damages fond which were not originally reported are either new in nature, or overlooked/missed in error, and shall bare full liability and responsibility for the condition of any vehicle purchased.

 

All sales are final unless otherwise declared on the invoice or in writing.

Customs Clearing & local licensing or other.

While Sushicars will aid and assist with informing the customer about the process where able, the sole responsibility for customs, inspections, registration or state, province, or other government or governing body compliance resides with the customer. Any change in regulation or compliance policy, law, legislation or rule or other is, without dispute, not the responsibility of Sushicars. The customer shall source all relevant information and documentation and shall take it upon themselves to be fully informed and aware.

Payment Options

 

We accept wire transfer, EFT/EMT (e-transfer) or in some cases, cash. Cash may require a declaration of funds in compliance with any local government, law or order as per the laws in which the country of transaction is conducted, or any country in which sushicars is required to report such deposit of cash. We strongly suggest wire/EFT/EMT for all parties best interests.

Paypal may be used from time to time, at the sole discretion of sushicars.com and its agents. 

​

Any additional fees incurred in the taking of these payments are the sole responsibility of the customer. 

​

If you require payment receipt outside of your own records, please advise us in advance. 

​

Payment​

​

Vehicles must be paid in full prior to shipping.

​

Unless otherwise stated, all funds are Canadian Dollars. 

 

Payment schedule & deposits (as of 2024 April 1st)

​

Unless otherwise agreed to in writing, customers shall pay the total amount, less $2,000 (two thousand dollars Canadian) to secure the vehicle and bring the vehicle in to our facility in Japan. Not all dealers in Japan will accept a deposit, for some vehicles, especially under $10,000 CAD this is quite normal. 

​

If you are concerned about losing a vehicle due to the time it takes to exchange funds, SushiCars will hold a "market averaged" deposit for a vehicle for up to 360 days. For more details, see "market average deposit" below. 

 

SushiCars will not promise to secure a vehicle with a deposit where one is not accepted. 

​

No arrangement will be made to ship the vehicle to customer unless the full invoiced amount is paid in full, including any and all exchange rates, fees or discrepancies. Delays in receipt of vehicle to customer due to late payment, including NSF/holds or other issues shall be the sole responsibility of the customer and any associated costs or fees incurred due to this shall be paid by the customer prior to shipment, regardless of, and in addition to the original invoiced amount.

Late Payments

​

SushiCars is not a lender. We do not lend, loan or extend credit to anyone unless otherwise agreed to in writing. Credit will only be considered for business to business sales.

​

Payment dates or arrangements missed due any reason outside of the control of SushiCars shall be subject to; 

​

Payments which are later than 30 days, from the date due, unless otherwise agreed to in writing in advance of payment date, shall be subject to a 5% invoice surcharge which must be paid in full, in addition to the original invoiced amount prior to shipping. Surcharge is based of the invoice total amount, not the amount withstanding/remaining balance. No exceptions. 

​

Payments which are later than 60 days, unless otherwise agreed to in writing in advance of payment date, shall be subject to a 10 % invoice surcharge which must be paid in full, in addition to the original invoiced amount prior to shipping. Surcharge is based of the invoice total amount, not the amount withstanding/remaining balance, but prior to prior surcharges if they apply. No exceptions.

Payments which are later than 30 days, unless otherwise agreed to in writing in advance of payment date, shall be subject to a 20% invoice surcharge which must be paid in full, in addition to the original invoiced amount prior to shipping. Surcharge is based of the invoice total amount, not the amount withstanding/remaining balance, but prior to prior surcharges if they apply. No exceptions. The full 100% of payment must be received no later than 90 days from the deposit date, or the customer will risk losing all right to claim the vehicle and shall forfeit the vehicle to SushiCars for cost recovery,

Deposit Return or refunds. 

​

Where able, SushiCars will return a deposit after 30 calendar days to the customer if the vehicle which is being purchased is found, by SushiCars or it's agents to not be as described or expected, or not available due to listing or other errors from the selling in country of it's origin. For example, if the vehicle is listed and a customer inquires, and subsequently pays a deposit to secure but the vehicle is found to be sold during the process, the deposit will be returned to the customer in accordance with the above schedule, less a $350 handling fee, which can be returned if the customer buys another vehicle or service from SushiCars, at their sole discretion. This is to protect SushiCars from being subject to wasted time from a customer who does not intend to buy, or our competitors from tying up resources with no financial implications. 

​

If a vehicle cannot be returned, for whatever reason, or due to a "final sale" clause in from the local dealer in Japan or other factor, SushiCars will offer to sell the vehicle for the customer, however we must disclose any issues to our customers. It shall be clearly understood that SushiCars, is in no way, offering to help the customer hide something to recover money. We are committed to making things right, and here to help, but we must uphold our standards, to our customers and clients alike.

The customer may elect to have SushiCars hold the deposit while searching for another vehicle. 

​

The refund of the deposit may be less than, but will not be more than the original amount, and will take into account any exchange rate/currency variations or, any expenses incurred by SushiCars in the inquiry process, such as, but not limited to, long distance call charges, tickets or transit or other. 

​

The deposit and vehicle purchase are, for this reason, split. There is no refund on a vehicle purchase except with the above exceptions or as noted within this document & clearly stated and understood that only a deposit, when not given to the seller in country of origin (i.e. Japan) shall be considered for return. 

​

Example: SushiCars takes deposit and inquires on a vehicle, but the vehicle seller has sold the vehicle and neglected to remove the listing or update it. Assuming that no expenses were incurred in this process, the customer shall receive a full refund on the deposit, within 30 days, if the deposit is not to be held and used for another vehicle. 

​

Services, as above and elsewhere in this document, will not be refunded. No exceptions. 

​

Market Average Deposits

​

In order to avoid losing a car purchase due to delays in funds, SushiCars may accept a "market average deposit" at the total amount quoted less $2,000 (two thousand dollars Canadian). 

​

This is to help customers secure the car they want, faster, as wire/EFT/EMT can take time to process to us, and then to the local dealer. 

​

The market average amount is a suggested amount to secure the vehicle based on local Japanese sales data and not a price guarantee. Customers will still be required to make a decision when a vehicle is found. No vehicle shall be purchased for the customer without their express written consent. The customer is in no way obligated to buy and is fully protected by the terms and conditions within this document and any agreements, written, in email or other, as arranged. 

​

Should a vehicle not be found within no less than 90 days, the customer may elect to retrieve the deposit or request to extend the term. The deposit shall be returned at the current exchange rate, less any fees or taxes if applicable and a $350 (three hundred and fifty dollars Canadian) admin fee. Customers are welcome to cancel this deposit at anytime. SushiCars will transfer the funds back to the customer as quickly as possible, and in no less than 10 business days. SushiCars is only required to transfer out the funds from our possession in that time. Receiving banks and financial institution holds will not be the responsibility of Sushicars.com. Same taxes and fees apply to voluntary withdraw of deposit.

Shipping (Expectations)

​

Warning. Once a vehicle has shipped, there shall be no expectation of changing any information, such as consignor or addressee for any document, item or the vehicle itself. It is the sole responsibility of the customer to ensure all address, name, contact information, is correct, when requested by Sushicars.com or it's authorized agents. Any customer who plans to move or relocate, or does not have a fixed address at time of shipping, which may change during vehicle transit or within no less than 12 months from time of shipping, it strongly encouraged to use an address which is fixed. Any costs associated with a change or address, including failure to deliver documents or vehicle, shall be the sole responsibility of the customer. 

​

Customers shall accept that while all best efforts are made by SushiCars to deliver their vehicle in the most timely manner possible, all vehicles using RORO (Roll On Roll Off) also known as "car carriers" or container loaded, while be subject to the schedules of the car carrier. SushiCars shall provide it's best and most honest estimation of shipping times, however delays to do war, disaster of natural or other nature, weather, volume or any other reason are not the responsibility of SushiCars. 

​

A general expectation may be that vehicles will take between 25 days and 70 days from leaving Sushicars Japan, and arriving at a port, such as Vancouver, BC, Canada. Other ports may be less or more but this is a normal and expected timeline in our experience, however sometimes may take longer. 

​

Once a vehicle has left the control of Sushicars, any further expenses shall be at the sole expense of the customer. 

​

At no time is it permitted for a customer to contact a shipping carrier, agent or service provider, other than SushiCars to inquire about their specific vehicle, as this relationship is to be exclusively maintained by SushiCars and it's agents or employees only. Contacting an agent or carrier directly may result in refused or cancelled services without any right or expectation to compensation or reimbursement/return or refund, based on the severity or the contact and communication and potential or actual damages. In some cases, SushiCars or it's parent company, Lazy Horse Media, may chose to pursue legal action against those who fail to adhere to this.

Agents/Importers/Exporters

​

SushiCars and Lazy Horse Media are primarily considered as a social media business, and also sell cars, parts and merchandise, along with services and other goods from time to time. We are not an importer for any country, for any commercial or personal goods, for any reason. Some agents, employees or associates may chose to import their own goods, and offer our consultation in service, however we are not to be considered an agent or any importation organization, group or company in anyway whatsoever. 

​

Referring to Sushicars, its owners, agents or partners, including parent company, may result in legal action against the customer. 

​

Sushicars will export the vehicle or parts from Japan or origin country, however the customer is solely responsible for their own import process to their destination country. 

​

Sushicars will assist in recommending a broker or service if required, however this recommendation is not to be seen in anyway as a partnership with that service. They are not an extension or affiliate of sushicars and as such, a third party to the sale. 

​

Hourly Labor, where applicable. 

​

Sushicars has an hourly labor of $195 (one hundred and ninety five dollars Canadian) for anything which is applicable, unless otherwise specified. Invoices without labor are not subject to it, unless specifically stated in writing. This is not a hidden fee, it is our posted rate if required, and for use in such cases where cost recovery or legal actions are required. Minimum 4 hours per. 

​

Legal or 3rd party consultancy or other is billed at $1,500 per hour, 2 hour minimum. 

​

Shipping (Insurance and Damages)

​

Where shipping is included in the sale, basic marine insurance shall be included, unless otherwise stated in writing, which will cover only total loss from shipwreck due to natural disasters only, and final decision of cause will be as per the shipping line, or marine carrier or agent of. Marine insurance claims will be no greater than 50% of the total invoice amount for the vehicle with a maximum of $5,000 (Five Thousand Dollars Canadian). Claims for vehicle damage during transit, such as bumper damage, cracks or glass breakage will be handled on a case by case basis. The motor vehicle carrier shall have control over the final decision in accordance with their respective policies. Cars must be signed for and inspected at the time of collection at the port in which they are picked up for any such claim to be accepted. Once a tow truck, owner, agent, family, friend or other person except the shipping company or it's agents have handled, moved, touched or received, the ability to claim from the motor vehicle carrier is lost. In such incident that the customer receives a car with damages, which were not as expected from the sale in Japan or other country of origin, and not expected or explicitly communicated as expected, the customer accepts that all claims shall be between them and the party handling or accepting the vehicle at that time.

Example, customer has had a tow truck collect the vehicle from the port in Seattle, and has has had the vehicle brought to them by a carrier in Oregon. Customer will then pursue the carrier or service which brought the vehicle from the port to Oregon. No claim shall, will, or can be made against SushiCars, it's parent or child companies, owners or operators or contractors, including the ocean carrier/shipping company used. 

Clearing Customs - Canada

At not point shall SushiCars be liable for clearing customs for a customer. SushiCars or it's agents may provide customs clearing through a 3rd party broker at the customers request at an additional cost, unless specifically included in the invoice. Customers are responsible to clear their own vehicles and ensure that they are not prohibited from importing the goods sold. 

​

Customers must ensure the vehicle is eligible for import prior to purchase. 

​

SushiCars is currently aware of a 15 year rule for Canada, and 25 year rule for the United States of America. However we are also aware some cars are not eligible in some states in the USA, but have no confirmed list, nor are we able to provide such a list. This is the responsibility of the customer. 

Vehicle Inspection 

​

Customers are responsible to ensure the vehicle is compliant and can be used for the purpose it was intended for. I.e., off-road vehicles without insurance, typically do not need inspection from a certified inspection shop or mechanic. Vehicles expected to be driven on the road, typically require a DOT, DMV, or other inspection prior to registration. SushiCars and its agents are not liable for if a vehicle can pass an inspection. 

​

We encourage the customer to find an inspection shop/facility/agent prior to purchase and consult them on the specifics of each car and what may be needed in modification or additional equipment to avoid complications. Typically this can be installing D.O.T tires, marker lights and daytime running lights, as an example. 

​

Note for British Columbia, Canada: In our experience each inspector can be different. Find someone who already has a Japanese Import (JDM) and ask them for guidance or call around some local shops to get a sense of which shops are willing to do the inspection, prior to the car landing in Canada. We found that this will ensure the most efficient spend of tow/transport from the port to the shop and avoid surprises.

 

As of November 2023 the BC Vehicle Inspection Facilities list (see below) lists many facilities which do not inspect Japanese vehicles and only do new cars or dealer cars. Please call first and tell them you have a Japanese import, and ask them what is normally required or see them in person to discuss.
